KoolBreeze Warranty Terms
Prices are subject to change without notice. All terms in writing supersede any oral or verbal agreement. This warranty shall not be or become effective unless KoolBreeze Inc. has been paid in full for all its work as per this agreement.
Acceptance of this agreement, including prices, specifications, and conditions, are satisfactory to OWNER, and I hereby agree to accept them. KoolBreeze Inc. is authorized to do the work specified. Payment will be made by OWNER as outlined above. I OWNER, HEREBY CERTIFY THAT I HAVE READ AND UNDERSTAND THE PROVISIONS CONTAINED IN THIS AGREEMENT AND I AGREE TO BE BOUND BY SAID PROVISIONS.
Any changes to standard terms and warranty must be in writing and signed only by management. Installation schedules are handled by the office and cannot be confirmed by the salesman. Scheduled dates are subjected to change due to weather, materials, or delivery.
Awning Warranty
KoolBreeze Inc. hereby warranties, subject to the conditions herein set forth during the period of 10-years labor and 20-years material warranty or manufacturer warranty. Complete structure with specified products when specified on terms of the agreement (per manufacturer’s specs) from the date of completion.
KoolBreeze Inc. provides a 10-year workmanship warranty for repairs. KoolBreeze Inc. will NOT warranty the workmanship on any awning due to harsh weather conditions. The purchaser must use care in maintenance, operation, use, and storage of the cover in accordance with manufacturer guidelines and product use guidelines. Any failure to maintain, operate, use, and store the product in accordance with the instructions will nullify this warranty and relieve KoolBreeze Inc. from any responsibility or liability under this warranty.
This Warranty is made subject to the following conditions and is given in lieu of any and all other Guarantees or Warranties whether expressed or implied. Specifically excluded from this warranty is any and all damage caused by the following lightening or windstorm, hailstorm, snow, and ice, or other unusual phenomena of the elements or act of God, roof, foundation or wall settlement or cracking failure or cracking of the cover defects or failure of material faulty construction of the parapet walls, coping chimneys, skylight, vents, supports or other parts of the building or fire. Nor are we responsible for property damage, or the consequences thereof, or personal injury, or the consequences thereof caused by chemical, biological or toxic agents or elements that may be part of any building material utilized in construction, including mold or other bio-growth (will not be liable for any claims related).
KoolBreeze Inc. will not be liable for consequential damages of any nature of description to any person or property. The owner is responsible to take all precautions to protect the building, its contents, and interior, such as vehicles, hanging pictures, light fixtures, or other valuables against vibration or jarring that may occur in preparation or application of your cover. KoolBreeze Inc. is not responsible for air conditioning units, television, antennas, guide wires, and cable services or adjustments/repairs of rooftop equipment or any other object at the installation surface. KoolBreeze Inc. will not be liable for any claims related, and the Owner will bear all expenses.KoolBreeze Inc. is not responsible for any damage to concrete, driveways, walkways, or any surface and or any mechanical parts caused by our dumpsters or equipment. If the cover is damaged by reason of any of the foregoing, this warranty shall thereupon become null and void for the balance of the warranty period. Work will be performed in a workmanship-like manner. Metal panel roofing systems may have an “oil can” effect due to materials and temperature changes OR minor blemishes/scratches. This does not have an affect on performance and is not cause for rejection by the owner.
Exclusions
KoolBreeze Inc. warranty is not responsible to cover damage to the awning system or its component parts caused by alterations to the property, including installation of steel roofs or solar panels installed above the awning and cause snowfall runoff and exceeds awning weight.
Collections
A finance charge of 1 1⁄2% per month (annual percentage rate 18%) of the unpaid balance will be added monthly. Should collection become necessary, the responsible party agrees to pay a collection fee of 40% and all legal fees of collection, with or without lawsuit, including attorney fees and court costs.
